TITLE: Patent Litigation and the Expert Witness

ABSTRACT:
Patent lawsuits have become a significant part of high-tech industry in recent years. 150,000 new patents are issued, and 1,600 patent lawsuits are filed, each year. Major electronics companies exchange hundreds of millions of dollars in court-ordered judgments, settlements, and jury awards, and they pay many millions more in legal fees. In a patent lawsuit, the attorneys can present legal arguments, but they cannot present technical arguments without relying on expert testimony. Thus the expert witness plays a pivotal role in the conduct, and the outcome, of patent litigation.

This seminar explains patent litigation, details the role of the expert witness, and gives examples from actual cases. Anyone contemplating serving as a testifying expert would benefit from this "inside-view" of the patent litigation process.

BIO:
Dr. Kenneth R. Castleman has a PhD in electrical engineering and has written three books and over seventy scientific articles in the field of digital image processing. He worked at the NASA Jet Propulsion Laboratory, served as CEO of a company he founded, and served on the faculty at The University of Texas and at Caltech. Dr. Castleman has extensive litigation experience, having served as an expert witness on two dozen patent cases and having over twenty days of deposition and ten days of courtroom testimony. He has filed numerous declarations and expert reports and has worked on cases both in federal district court and before the United States International Trade Commission. He is skilled at explaining complex technical issues to non-technical persons and at applying patent claim language to commercial products and to the published literature.
